The Legality of Online Gambling

 

Gambling has been around for centuries, but the internet has taken it to the next level. Several of these have been challenged on the grounds of First Amendment freedom of speech. While these attacks have had limited success, the commercial nature of the gambling industry seems to satisfy the Constitution’s Commerce Clause.

In addition to state laws, the federal government has taken a strong stance on gambling. The Unlawful Internet Gambling Enforcement Act, for instance, regulates commercial activities. Also, PayPal has been warned that it could face prosecution for accepting payments from illegal Internet bets.

Another potential threat is the proliferation of mobile devices. While some states have passed legislation that prohibits or limits mobile gaming, others haven’t. Many casino operators have started offering mobile versions of their sites, which makes it easier for players to access the gambling experience.
